ModSolar complies with the U.S.–E.U. Safe Harbor framework and the U.S.-Swiss Safe Harbor framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal data from European Union member countries and Switzerland. ModSolar adheres to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement. About ModSolar and the Personal Information ModSolar collects
Personal Information Collected by ModSolar
Several forms on the ModSolar Platform collect certain information you voluntarily choose to share with ModSolar, such as the name, email address, postal address, phone numbers, and other information that may identify you or your Clients (“Personal Information”). You may always choose not to provide Personal Information; however, this may limit ModSolar’s ability to provide you and your Clients with our Services or content. ModSolar may also collect other data, such as photographs of a house or office, which may include Personal Information.
Information Used by ModSolar and its Partners
ModSolar works with other companies (each, a “Partner”) to provide the ModSolar Platform and Services. Personal Information about your use of the Platform and Services may be used by ModSolar and its Partners.
When you use the Platform or Services, we will automatically collect information on the type of device you use, operating system version and the device identifier (or “UDID”).
We may collect information about your location and the location of each of your Clients for the purpose of providing you with Services, including matching your location or the location of your Clients with maps and satellite photographs as part of the Services. In addition to storing this Personal Information for future access by you, we may share this information with our mapping, photography and other providers for the purpose of providing you and your Clients the Services. If you no longer wish to allow us to track your location-based information within the mobile application you may turn this off at the device level, however you will no longer be able to use parts of our Platform or our Services if you do so.
Information Related to Data Collected About our Clients
ModSolar collects information under the direction of its Customers, and has no direct relationship with our Customer’s Clients or other individuals whose Personal Information ModSolar processes. If you are a Client of one of our Customer and would no longer like to be contact by any of our Customers that use our Services, please contact the Customer that you interact with directly. We may transfer your Personal Information to companies that help us provide our Services. Transfers to subsequent third parties are covered by the service agreements with our Customers and Partners.
Access and Retention of Data Controlled by ModSolar
ModSolar has no direct relationship with many of the Clients or other individuals whose personal data it processes. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct their query to ModSolar’s Customer, which is the data controller of the Client’s Personal Information. If the Customer or a Client requests ModSolar to remove the Client’s Personal Information, we will respond to the request within 30 days.
We will retain Personal Information we process on behalf of our Customers and their Clients for as long as needed to provide Services to our Customers and their Clients. ModSolar will retain and use this Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
As is true of most web sites and software apps, we gather certain information automatically and store it in log files. This information includes Internet protocol (“IP”) addresses, browser type, Internet service provider (“ISP”), referring/exit pages, operating system, date/time stamp, and clickstream data (collectively, “Non-Personal Information”).
We use this Non-Personal Information, which does not identify individual users, to analyze trends, to administer the site, to track users’ movements around the site and on the Platform, and to gather demographic information about our user base as a whole.
We do not link this automatically-collected data or other Non-Personal Information to Personal Information.
We use both session ID cookies and persistent cookies. We use session cookies to make it easier for you to navigate our Platform. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in your Internet browser’s “help” file.
We set a persistent cookie to store your password, so you don’t have to enter it more than once. Persistent cookies also enable us to track and target the interests of our users to enhance the experience on our Platform.
If you reject cookies, you may still use our Platform, but your ability to use some areas of our Platform, will be limited.
Third Party Cookies and Other Tracking Technologies
Our third party Partners may employ images and scripts that help them better manage content on our Platform. They do not tie the information they gather to our Customer’s and their Clients Personal Information.
Some of our Partners may provide certain features on our Platform or to display advertising based upon your Web browsing activity, and may use Flash cookies to collect and store information.
Flash cookies are different from browser cookies because of the amount of, type of, and how data is stored. Cookie management tools provided by your browser will not remove Flash cookies. We use mobile analytics software to allow us to better understand the functionality of our Platform on your mobile device. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and where the application was downloaded from. We do not link the information we store within the analytics software to any Personal Information you submit within the application.
Use of Information by ModSolar
Use of Personal Information by ModSolar Customers
Customers using ModSolar’s Platform and Services to generate sales proposals may receive or access their Clients’ Personal Information in conjunction with the Customer’s use of the Services. Each Customer and Client may at any time choose to opt out of receiving further communications from ModSolar. However, even if ModSolar blocks further communications to Customer or Client, ModSolar cannot prevent Customers who have obtained Client Personal Information from contacting the Client directly. ModSolar recommends that each Client contact each Customers directly if you wish to opt-out of further communications from that Customer.
We use your Personal Information and other information to help you prepare proposals for your Clients, allow you to request a demo, and to contact you regarding any inquiries you have.
Disclosures of Your Personal Information, ModSolar Communications Content, Data and Information
We may provide your Personal Information to third parties, including companies that provide services to help us with our business activities such as a live help feature or offering customer service. These companies are authorized to use your Personal Information only as necessary to provide these services to us.
We may provide your Personal Information to our Partners and third parties:
a. as required by law, such as to comply with a subpoena, or similar legal process;
b. when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
c. if ModSolar is involved in a merger, acquisition, or sale of all or a portion of its assets to a third party, you will be notified via email and/or a prominent notice on our website of any change in ownership or uses of your Personal Information, as well as any choices you may have regarding your Personal Information.
Also, certain technical processing of messages and their content may be required to: (1) send and receive messages; (2) conform to connecting networks’ technical requirements; (3) conform to the limitations of the Platform or the Services; or (4) conform to other similar requirements.
The Platform has industry standard security measures in place to protect the loss, misuse and integrity of the Personal Information under ModSolar’s control. Although ModSolar makes good faith efforts to store the information collected by the Platform and the Services in a secure operating environment that is not available to the public, ModSolar cannot guarantee complete security. You acknowledge that you provide your Personal Information and the Personal Information of your Clients at your own risk.
The security of the Personal Information collected is of the utmost importance to ModSolar. ModSolar takes all commercially reasonable steps to secure your Personal Information. Reasonable physical, electronic, and managerial procedures to safeguard the information we collect has been implemented and is updated periodically as deemed appropriate by ModSolar. With this in mind, ModSolar limits access to Personal Information to only those employees and contractors who need access in order to perform their duties.

Access to Personally identifiable information
If your Personal Information changes or if you no longer desire our to use our Platform or Services, you may correct, delete inaccuracies, or modify it by making the change within the account section of the Platform or by emailing us at removeme@ModSolar.net. We will respond to your access request within 30 days.
We will retain your information for as long as your account is active or as needed to provide you Services. If you wish to cancel your account or request that we no longer use your information to provide you Services contact us at removeme@ModSolar.com. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
