This privacy policy (“Privacy Policy”) addresses how MODsolar, LLC (“MODsolar”, “we”, “us”, “our”) collects, uses and discloses personal information about people who visit or use our software or services (“Customers”, “you”, “your”). We also collect and use personal information about your clients (“Clients”) while on our site at or using our software applications (collectively, the “Platform”). Access to and use of MODsolar Platform and the services provided by MODsolar (collectively, the “Services”) are subject to this Privacy Policy. The use of information collected through our Service shall be limited to the purpose of providing the Services for which each Customer has engaged MODsolar.



MODsolar complies with the U.S.–E.U. Safe Harbor framework and the U.S.-Swiss Safe Harbor framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal data from European Union member countries and Switzerland. MODsolar adheres to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement. However, it is important to note that the Platform and its servers are operated in the United States of America. If you are located outside of the United States, please be aware that any Personal Information we gather will be transferred to the United States. By using the MODsolar Platform or Services, you consent to this transfer and our use of the Personal Information in accordance with this Privacy Policy.

In order to comply with the Safe Harbor framework, MODsolar commits to the resolution of complaints about your privacy and our collection or use of your Personal Information. We have also committed to resolve any complaints by European Union or Swiss citizens relating to this Privacy Policy, which cannot be resolved directly with MODsolar, through the International Centre for Dispute Resolution/American Arbitration Association (“ICDR/AAA”) Safe Harbor Program.

MODsolar is committed to protecting your privacy and has created this Privacy Policy to inform you about how MODsolar protects your information. This Privacy Policy only applies to transactions and activities in which you engage, and data gathered, on the MODsolar Platform. This Privacy Policy does not apply to any website or software owned or operated by anyone else. This Privacy Policy does not apply to any hard copy or any offline point of contact.



Several forms on the MODsolar Platform collect certain information you voluntarily choose to share with MODsolar, such as the name, email address, postal address, phone numbers, and other information that may identify you or your Clients (“Personal Information”). You may always choose not to provide Personal Information; however, this may limit MODsolar’s ability to provide you and your Clients with our Services or content. Modsolar may also collect other data, such as photographs of a house or office, which may include Personal Information.



MODsolar works with other companies (each, a “Partner”) to provide the MODsolar Platform and Services. Personal Information about your use of the Platform and Services may be used by MODsolar and its Partners.

When you use the Platform or Services, we will automatically collect information on the type of device you use, operating system version and the device identifier (or “UDID”).

We may collect information about your location and the location of each of your Clients for the purpose of providing you with Services, including matching your location or the location of your Clients with maps and satellite photographs as part of the Services. In addition to storing this Personal Information for future access by you, we may share this information with our mapping, photography and other providers for the purpose of providing you and your Clients the Services. If you no longer wish to allow us to track your location-based information within the mobile application you may turn this off at the device level, however you will no longer be able to use parts of our Platform or our Services if you do so.



MODsolar collects information under the direction of its Customers, and has no direct relationship with our Customer’s Clients or other individuals whose Personal Information MODsolar processes. If you are a Client of one of our Customer and would no longer like to be contact by any of our Customers that use our Services, please contact the Customer that you interact with directly. We may transfer your Personal Information to companies that help us provide our Services. Transfers to subsequent third parties are covered by the service agreements with our Customers and Partners.



MODsolar has no direct relationship with many of the Clients or other individuals whose personal data it processes. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct their query to MODsolar’s Customer, which is the data controller of the Client’s Personal Information. If the Customer or a Client requests MODsolar to remove the Client’s Personal Information, we will respond to the request within 30 days.

We will retain Personal Information we process on behalf of our Customers and their Clients for as long as needed to provide Services to our Customers and their Clients. MODsolar will retain and use this Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.



As is true of most web sites and software apps, we gather certain information automatically and store it in log files. This information includes Internet protocol (“IP”) addresses, browser type, Internet service provider (“ISP”), referring/exit pages, operating system, date/time stamp, and clickstream data (collectively, “Non-Personal Information”).

We use this Non-Personal Information, which does not identify individual users, to analyze trends, to administer the site, to track users’ movements around the site and on the Platform, and to gather demographic information about our user base as a whole.

We do not link this automatically-collected data or other Non-Personal Information to Personal Information.

We use a third-party tracking service called Google Analytics that uses cookies to track Non-Personal Information about visitors to our Platform and users of our Platform in the aggregate (browser version, geographic region, click path, and bounce rates) to improve the end user experience.



A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. We use cookies on our Platform. We link the information we store in cookies to Personal Information you submit about you and your Clients while on our Platform.

We use both session ID cookies and persistent cookies. We use session cookies to make it easier for you to navigate our Platform. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in your Internet browser’s “help” file.

We set a persistent cookie to store your password, so you don’t have to enter it more than once. Persistent cookies also enable us to track and target the interests of our users to enhance the experience on our Platform.

If you reject cookies, you may still use our Platform, but your ability to use some areas of our Platform, will be limited.



The use of cookies by our Partners is not covered by this Privacy Policy. We do not have access or control over these cookies. Our partners may use session ID cookies to anonymously track page interactions, which may improve your user experience.

Our third party Partners may employ images and scripts that help them better manage content on our Platform. They do not tie the information they gather to our Customer’s and their Clients Personal Information.

Some of our Partners may provide certain features on our Platform or to display advertising based upon your Web browsing activity, and may use Flash cookies to collect and store information.

Flash cookies are different from browser cookies because of the amount of, type of, and how data is stored. Cookie management tools provided by your browser will not remove Flash cookies. We use mobile analytics software to allow us to better understand the functionality of our Platform on your mobile device. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and where the application was downloaded from. We do not link the information we store within the analytics software to any Personal Information you submit within the application.



MODsolar uses the collected Personal Information to verify your identity and to contact you in connection with your use of the Platform and the Service, and to help you provide your services to your Clients. If you opt-in to a Service that generates communications to you from MODsolar (other than communications sent to you for the sole purpose of addressing a technical or operational issue regarding the MODsolar Platform or Services), you will be given the opportunity to opt-out of receiving further such communications from MODsolar. Except as provided in this Privacy Policy, MODsolar does not sell, share or otherwise provide any Personal Information you give to us with any third party other than our Customers and their Clients.



Customers using MODsolar’s Platform and Services to generate sales proposals may receive or access their Clients’ Personal Information in conjunction with the Customer’s use of the Services. Each Customer and Client may at any time choose to opt out of receiving further communications from MODsolar. However, even if MODsolar blocks further communications to Customer or Client, MODsolar cannot prevent Customers who have obtained Client Personal Information from contacting the Client directly. MODsolar recommends that each Client contact each Customers directly if you wish to opt-out of further communications from that Customer.

MODsolar works with its Customers to help them provide notice about their use of the Personal Information, including (1) the purposes for which Personal Information is collected and used; (2) a contact person whom enquiries or complaints may be directed; (3) the types of third parties to whom Personal Information is disclosed; and (4) the choices and means that individuals are offered for limiting use and disclosure of personally identifiable information. The privacy practices of Customers who use the Platform or the Services are not covered by this Privacy Policy. Please contact those organizations directly for more information about their privacy practices.

We use your Personal Information and other information to help you prepare proposals for your Clients, allow you to request a demo, and to contact you regarding any inquiries you have.



We will share your Personal Information with third parties only in the ways that are described in this Privacy Policy. We do not sell your Personal Information to third parties.

We may provide your Personal Information to third parties, including companies that provide services to help us with our business activities such as a live help feature or offering customer service. These companies are authorized to use your Personal Information only as necessary to provide these services to us.

We may provide your Personal Information to our Partners and third parties:

1. as required by law, such as to comply with a subpoena, or similar legal process;

2. when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;

3. if MODsolar is involved in a merger, acquisition, or sale of all or a portion of its assets to a third party, you will be notified via email and/or a prominent notice on our website of any change in ownership or uses of your Personal Information, as well as any choices you may have regarding your Personal Information.

Also, certain technical processing of messages and their content may be required to: (1) send and receive messages; (2) conform to connecting networks’ technical requirements; (3) conform to the limitations of the Platform or the Services; or (4) conform to other similar requirements.



The Platform has industry standard security measures in place to protect the loss, misuse and integrity of the Personal Information under MODsolar’s control. Although MODsolar makes good faith efforts to store the information collected by the Platform and the Services in a secure operating environment that is not available to the public, MODsolar cannot guarantee complete security. You acknowledge that you provide your Personal Information and the Personal Information of your Clients at your own risk.

The security of the Personal Information collected is of the utmost importance to MODsolar. MODsolar takes all commercially reasonable steps to secure your Personal Information. Reasonable physical, electronic, and managerial procedures to safeguard the information we collect has been implemented and is updated periodically as deemed appropriate by MODsolar. With this in mind, MODsolar limits access to Personal Information to only those employees and contractors who need access in order to perform their duties.



Our Platform includes links to social media websites and applications (“Social Media Features”), such as the Facebook Like button and Widgets, such as the “Share This” button or interactive mini-programs that run on our Platform. These Social Media Features may collect your IP address, which page or portion of our Platform you are visiting, and may set a cookie to enable the Social Media Feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Platform. Your interactions with each Social Media Feature is governed by the privacy policy of the company providing it.



In the event that Personal Information is compromised as a result of a breach of security, MODsolar will promptly notify those persons whose Personal Information has been compromised, in accordance with the notification procedures set forth in this Privacy Policy, or as otherwise required by applicable law.
